For three years, Fate Brewing Company in Scottsdale and a Colorado brewery shared the same name. That will change soon in response to a legal challenge by the Colorado business.
The local brewery has two locations in Scottsdale. Fate South, near Scottsdale and McDowell roads, will officially become McFate Brewing Company, according to owner Steve McFate. The original, Fate North, at Scottsdale Road and Shea Boulevard, will become McFate’s Tap + Barrel.
Most of the re-branding already has been done, and a re-launch party will be held at the south Scottsdale site on Saturday, June 25. The settlement deadline is in early August and the new names at both locations will be in effect by then.
The owner of Boulder-based Fate Brewing Company filed a lawsuit, and McFate said he tried to negotiate over the course of a couple months, even talking about co-marketing and promotion options, but in the end, both wanted their independence.
“It’s painful to do and emotional, but we’re trying to put it behind us and not worry about stepping on toes,” he said. “It would cost a bunch of money to commit to fighting the lawsuit, we’re simply going to bite the bullet.”
The Scottsdale brewery debuted in 2012, before the Colorado brewery. However, McFate said, the Colorado owner filed for a trademark on the name before he did, which makes the situation difficult.
